Default non compete clause!

hi all,
I have an employment contract that has a non-compete clause - three years after leaving the job, employee shall not directly compete with employer within a specific radius of employer office. by considering a breach of this covenant by working within a that radius, will the court likely uphold the clause where there are no stipulated damages?

whether there is any damage or not, breech of contract is a serious issue and you cant simply do it and escape w/o penalty.
