Default is this offence?

Hello,
My company withdrew a cashiers check for rent. The money was not immediately taken from the account, and my partner withdrew the cash and used it for other supplies. This means the bank paid the cahsiers check and then allowed us to withdrawl over $10,000 dollars. Now they want the money back. Is this a criminal offense?

Yes. But the bank probably won't pursue it as such unless you refuse to pay the bank back their money. You are liable for the $10,000. It's not the bank's fault that you and your partner have communication problems.
