Few months ago, in a restaurant deal, I signed a personal guarantee to a food vendor that has language indicating absolute, continueing, and irrevocable. Finding a fraud being perpetrated by the restaurant owner, I sent letters rejecting my personal guarantee that I would not be responsible for any future liabilities of the company. The vendor stopped doing any business with the restaurant, then began doing business with them again after few months. Ultimately they did not get paid for food supplied to the restaurant, and have now sued me based on my original personal guarantee. Can they come after me for liabilities incurred after I put them on notice? Since they stopped doing business with the restaurant after receiving my notice indicate they accepted the new terms of our agreement?
