Default non-payments??

Hello All of you,
I runs a construction company and is having some problems with customers payments. The basic agreement was that the money to pay me would come from the sale of the home. But with the recent drop in the market, many of these homes have been on the market for many months, and I m out tens of thousands of dollars across all of the open accounts.
I am thinking of trying and forcing the hand of the realtor, that if they don't work out some sort of payments with the home owners, I would take the owners to small claims.
Is it legal in anyway? Any help offered is welcomed and would be greatly appreciated!

Going by the lien, you still won't get paid until the house is sold. Contact the owners/realtor for payments.
