Question They are trying to garnish my wifes wages

I am on the verge of chapter 7 for a lot of debts incurred prior to my marriage. i consulted with an attorney about a month ago and was advised and shown the WI statute that says they can not garnish her wages. I dropped the ball and should have started the bk work but I have not as of right now.

My concern is primarily for my wife as she is going through the normal embarressment, anger and scared feelings. Plus I am currently not making any money and my wife supports my family.

Is the collection place just trying to intimidate her or can they really garnish her wages?

Please advise or respond with more questoins as I would like to give my wife some info to sleep on. I willbe here all night if I have to be.

Hi,
Sometimes the procedure takes time to complete all the formalities. Ask your wife to be brave and there seems nothing to worry. Just be in contact with them and keep yourself updated.

They have already sent papers to my wifes work. That is my my wife is irate and embarressed.

Seems like you are in a bind and you may need to go to the extremes to get rid of this. Suggestions may include to trying to settle the debt by selling off assets (that old car you were going to "fix" and all the tools that was bought to fix it), refinancing the debt (using home equity, car leins, etc), and, of course, using savings to pay. Also, finding gainful employement (or filing for SSDI if disabled) and dropping unneeded bills (cable t.v., internet, magazines, eating fast food all the time, and that stupid Starbucks habit) will make things easier for your wife to sleep and allow you to get the 5,000lb gorilla that debt can be off your back.
