yesterday, I got a call from a waitress, claimed to have spit in my food. calling the owner of the resturant the next day and brought the matter to attention. she said that nothing was going to be done about it since there was no proof. What actions can I take?

very difficult to prove such an acts. look out for an eye witness, if any.
