Last month, I was arrested and charged with entering a police vehicle and removing an officer’s cell phone and car keys. This all happened after the police picked me up for suspected DWI. They did not charge me with DWI, but found I was under the influence of something. I was told that they let me step outside to smoke a cigarette, I entered a police car took the car keys and cell phone that were in the car, and threw them into some bushes. An officers came outside and witnessed me doing this. I will soon be interviewed by the criminal division of the superior court. I was never charged with dui. I actually don’t have full recollection of what happened because of the medication. Can I tell the Criminal Division that I was on this medication?

Exercise your right to remain silent and don't admit to anything if you are interviewed. If you are indicted whatever charges they bring can be addressed at that time, and perhaps your lawyer can use the medication you took as a means of defending you against the charges.
