Default is this case of malpractice?

Hello there,
Sister was divorced many years ago. Attorney advised not to negotiate ex's federal pension as it would continue after his death. His ex just retired and have now found out that original divorce attorney did not use proper language and that she have no surviorship rights. Is this a case of malpractice?

You need a careful analysis and guidance. If you waive and give up all rights to ex's pension that would be very bad indeed. if nothing was done, the issue was left open, you then have to go back to Court. Providemore facts to determine whether your attorney committed fatal errors or not.
