Default no more s/l?

Hi there,
I was Involved in slip and fall in major market chain in 1/04. Atty retained but failed to file within 7 months. Last year, he filed Pet. to Compel Arb with court stating that since ins carrier had previously agreed that they should be held to it. If s/l ran, is there any other remedy avail or is Petition OK? Please advise.

Blowing the statute is surely a malpractice. It doesn't look like the arbitration petition is going to go anywhere. Contact another attorney to help you get your complete file from first attorney, and go from there. Also, file a complaint with the State Bar.
