I am looking to get a law suit going concerning my father's death. i have had an independent autopsy done and i am ready to procede. Lawyers say they cannot take the case as this doctor don't have any malpractice insurance and because of his lack of insurance there wont be enough money to go around. have you ever heard of such a thing?

I guess the issue is not the lack of insurance. If a doctor negligently kills someone without a spouse or child under 25 then he or she cannot be sued.
