Default suing for dental malpractice??

Hello friends,
My new dentist just found a piece of dental pick that was left in my tooth from an older root canal. While he says it was not ''dangerous'', just ''unprofessional'', I'm still concerned. Should I be thinking about suing the old dentist?

You described a 'possible' violation of the standard of care, but, you have some reassurance from the second dentist that there was no actual harm caused by the retained dental pick. No damages = no case.
