Default nerve damaged during op.

hello people,
I had a lower back fusion few years back and I have undergone a second surgey to repair the first surgery. My new surgeon told me that there is a permanent nerve damage done in the first surgery and nothing can be done to repair it. Do I have a case and is so can I sue the doctors malpractice carrier? thankz!

consult your case with a medmal attorney and discuss your concerns like known risks associated with the surgery, failure for the 'fusing' to occur, the applicable statute of limitations.
