Default photos published w/o consent.

an adult magazine was taking photos of girls for advertisement. the photographer aproached me and asked if he could take some photos to keep on file for the club. I asked if they would be in the magazine, he replied no. He took some photos but they have been published in several issues of the magazine. Do I have any kind of a case against the magazine or maybe the photographer? please reply. I feel my rights have been violated.

no one can use a picture of someone else in an advertisement without consent, if the picture is used in such a way to imply endorsement or any other association with the product, service or place being advertised.
