Default rights violation?

During the holiday, a friend and I made a trip. at we were pulled over by the police though we wasn't speeding or weaving. My friend had lost his license, as his license came back suspended. The officer continued with a DUI test, because my friend's eyes were "glossy". Anyway, my friend was arrested for driving with a suspended license. The police then searched the car and found nothing. Is this legal? Isn't this against his rights?
