I want to know if an employee was hurt at the work site, but was not on the clock, does the employer have to file a claim? The employer is paying for the damage through their insurance, but is not sure if they have to file a workers' comp claim. What do you think?

This might be treated as a work injury, especially if the question related to work. However, consult a Personal Injury attorney to make certain no civil claim can be filed. Also, fill out a notice of injury form and give it to the employer.
